Declaratory Orders and Rulemaking Petitions

The Department has received the following Declaratory Order(s). As provided for by Iowa Code section 17A.9(1), “[a]ny person may petition an agency for a declaratory order as to the applicability to specified circumstances of a statute, rule, or order within the primary jurisdiction of the agency.”

The Department has adopted by reference in 561 Iowa Administrative Code chapter 6 the Uniform Rules on Agency Procedure governing how, when, and why it will or will not respond to a declaratory order; the model rules are available here.

The Department has received the following rulemaking petition(s). As provided for by Iowa Code section 17A.7(1), “[a]n interested person may petition an agency requesting the adoption, amendment, or repeal of a rule.”

The Department has adopted by reference in 561 Iowa Administrative Code chapter 5 the The Uniform Rules on Agency Procedure governing the format, substance, and procedure for rulemaking petitions; the model rules are available here.
