DNR enforcement actions

DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Allamakee County
Donahue’s One Stop, L.L.C.
Comply with DNR regulations and financial assurance requirements and pay an administrative penalty of $2,500.

Franklin County 
Seabee
Submit Title V emissions inventory; submit a corrective action plan to ensure with compliance with permit deadlines; comply with all requirements of the Title V permit; and pay an administrative penalty of $2,500.

Johnson County 
Eldon C Stutsman
Order 1 - Comply with asbestos regulations and pay an administrative penalty of $6,500
Order 2 - Comply with open burning and solid waste disposal regulations; dispose of any solid waste on property and submit landfill receipts; and pay an administrative penalty of $10,000.

Woodbury County
Midnight, LLC
Pay an administrative penalty of $4,000.

Worth County
New Heaven Chemicals Iowa, LLC
Submit Title V application; Comply with 40 CFR 63 Subparts F, G, and H, and pay an administrative penalty of $10,000.
