DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

JC Manning Investments, LLC
Cease all illegal open dumping, open burning, and improper solid waste disposal; remove and properly dispose of all solid waste on site and submit landfill or recycling facility receipts; and pay a $7,200 administrative penalty.

City of West Des Moines
Cease all illegal discharges to waters of the state; comply with all conditions of the National Pollutant Discharge Elimination System permits; and pay a $8,000 administrative penalty.
Scott County
J.C. Dillon, Inc.
Send at least one company principal to an Environmental Protection Agency-approved "Asbestos Inspector" course and submit proof of completing and passing the course; comply with all asbestos regulations in the future; and pay a $10,000 administrative penalty.

Saddle Ridge, LLC
Cease all illegal discharges to waters of the state; comply with all conditions of the National Pollutant Discharge Elimination System permits; and pay a $5,000 administrative penalty.
Webster County
Cerne Calcium Carbonate Company, LLC
Submit a construction permit application to install a bag leak detection system (BLDS) on the enclosed truck loadout with baghouse; develop and submit for approval a BLDS monitoring and corrective action plan; conduct visible emissions observations on all permitted emissions points while equipment is operating once per calendar day using Environmental Protection Agency Method 22 and record all observations; initiate corrective actions if any visible emissions are observed; maintain records of all inspection records and sheets, and maintenance records for all baghouses at the facility; conduct compliance stack testing on emission points 2, 16, and 17 for particulate matter, particulate matter 10, particulate matter 2.5, and opacity; subsequent stack testing shall be performed every 3 years; if any test demonstrates noncompliance for a pollutant, testing shall increase to an annual basis for the noncompliant emission point and pollutant until two consecutive stack tests demonstrate compliance, at which point testing may return to the every 3-year schedule; submit construction permit applications for emission points 2, 16, and 17 to add stack testing requirements consistent with this order; develop and submit for approval a maintenance plan for each baghouse; and pay a $8,000 administrative penalty.
