Proposed Administrative Rules or Rule Revisions

The Administrative Procedures Act, Iowa Code chapter 17A, requires all state agencies to promulgate rules for the operation of their programs. The rulemaking process increases agencies’ accountability to the public, allows public participation in the formulation of rules, and provides legislative oversight for program operations.

Below are the recent rulemaking activities that are being considered, have been proposed or are in the process of being adopted by the DNR for the chapters administered by the Solid Waste section and the Financial and Business Assistance section. Many of these proposals are a direct result of the comprehensive five year rule review required by 17A.7(2) and Executive Order 10 signed by the Governor on January 10, 2023.

Waiver Request Form

Pursuant to Iowa Code section 17A.9A and 7 Iowa Administrative Code Chapter 2504, a petitioner must provide comprehensive justification of a proposed request for a waiver to an administrative rule as adopted by the DNR.

This form will assist you in providing all pertinent information that is necessary for the DNR to grant a waiver. The form must be submitted to the DNR and must contain an adequate amount of factual and concise information. The obligation rests with the petitioner to provide convincing evidence to justify the granting of a waiver. You may provide additional information or attach additional pages if needed. The DNR reserves the right to require additional information to further support request for a waiver.
