DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Lee County

JWC Futures, LLC

Prior to restarting the facility, either (1) modify air quality construction permits to reflect current operations and to account for any unpermitted equipment at the facility, and obtain new permits before constructing or installing new equipment; before selling or transferring the facility, disclose to the buyer in writing that existing air quality construction permits are inaccurate and noncompliant and must be modified, and submit proof of this disclosure in conjunction with ownership transfer notification documents; OR (2) voluntarily rescind all permits and cease operations; and (3) pay a stipulated $4,000 administrative penalty.

Plymouth and Woodbury Counties

Knife River Midwest, LLC

Retest the Hot Mix Asphalt Plant for carbon monoxide, particulate matter, and particulate matter 10 while producing the worst-case air emissions at the plant's maximum capacity; submit any required construction permit applications based on the stack test results; submit a construction permit application for the asphalt cement tank or a permit exemption justification; and pay a $10,000 administrative penalty.

Responsible parties have 60 days to appeal the order or 60 days to pay the penalty.
