DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Calhoun County
City of Rinard
Submit the information required in the compliance schedule; submit a written progress report every 90 days until all milestones in the compliance schedule have been satisfied; and pay a stipulated $800 administrative penalty.
Emmet County
Farmers Union Industries, LLC d/b/a Central Bi-Products
Comply with the terms of the treatment agreement or negotiate higher treatment agreement limits with the City; retain a third-party professional engineer to investigate the source of the discharge and submit to the DNR the investigation results and a proposed schedule for correcting any noted deficiencies; and pay a $10,000 administrative penalty.

Pay a $3,000 administrative penalty.
Iowa County
Maverik Group, LLC d/b/a Maverik, Inc.
By October 2027 complete all necessary troubleshooting, operational adjustments, and physical modifications to the wastewater treatment facility to comply with its National Pollutant Discharge Elimination System (NPDES) permit limits; submit written progress reports every 90 days until NPDES permit limits are met for three consecutive months; and pay a $5,000 administrative penalty.

Conduct stack testing on the Induction Furnaces for federal and state particulate matter emission limits; testing must be completed at the maximum rated capacity; notify DNR prior to all future stack test events and submit test protocols and results as required by law; notify DNR prior to decommissioning or selling the facility; and pay a $10,000 administrative penalty.

Chem Go of Houghton, Inc.
Cease all non-permitted discharges into the onsite stormwater inlet and receiving stream; develop and implement a standard operating procedure requiring all sprayer equipment and cleanout activities to occur away from stormwater inlets, or construct appropriate secondary containment infrastructure to capture all washwater; provide documentation of how it contained, collected, and disposed of the wastewater from the unauthorized discharge; and pay a $5,000 administrative penalty and $2,157.09 fish restitution.
