DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Comply with all conditions of the drinking water and wastewater operator two-year probation; submit a comprehensive Corrective Action Plan detailing the administrative and operational protocols to be implemented to ensure all sampling, reporting, and 24-hour emergency notifications are completed accurately and on time across all contracted facilities; submit an Operation and Maintenance Plan that provides a schedule and list of responsibilities for each facility where Ms. Guy serves as the operator-in-charge; physically log facility visits and include the date, time of arrival, time of departure, signature, and a summary of duties performed; submit equipment status documentation certifying the functionality of each lift station alarm and composite sampler for each wastewater facility required to have composite samplers; submit all missing written sampling plans for lead and copper rule, revised total coliform rule, groundwater rule, and for nitrate and asbestos monitoring, provide monthly compliance summaries; and pay a $1,000 administrative penalty and a stipulated $500/per future violation administrative penalty.
