DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Greene County
Landus Cooperative - Grant
Submit for review and approval a compliance plan identifying corrective actions and implementation schedules for the grain receiving, grain handling ,and grain loadout operations; the compliance plan shall identify operational maintenance, procedural, engineering, equipment, or control measures necessary to achieve compliance, including installation of additional dust control measures; apply for standard air quality construction permits for the grain receiving operation, grain handling, and grain loadout operation at the facility within 30 days of approval of the compliance plan; once the permits are issued, complete opacity monitoring to demonstrate compliance with air quality construction permits and comply with all permit conditions in a timely manner; certify an employee as an EPA Method 9 observer and at all times retain an employee on staff with such certification; provide a written stack test report for review within 42 days of completion of the testing; and pay a $10,000 administrative penalty.
Muscatine County
Muscatine Used Parts, Inc. d/b/a Muscatine Metal
Send at least one company principal to an EPA-approved "Asbestos Inspector" course and submit proof of completing and passing the course; comply with all asbestos regulations in the future; correct the illegal disposal of asbestos-contaminated materials on site and submit proof of disposal at an asbestos-approved landfill; and pay a $10,000 administrative penalty.

D&B Hickory Grove, LLC
Cease all illegal discharges to waters of the state; comply with all provisions of its National Pollutant Discharge Elimination System permit; ensure there is continuous oversight of the facility by certified wastewater treatment facility (WWTF) operator, install warning signs every 500ft around the perimeter of the WWTF; install an influent flow meter and ensure it is properly calibrated and maintain a record of each calibration; and pay a $5,000 administrative penalty

Cease all illegal open dumping, open burning, and improper solid waste disposal; lawfully dispose of all solid waste on site and ensure no further burning occurs; provide landfill or recycling receipts documenting proper disposal; and pay a $10,000 administrative penalty.
