DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Calhoun County

City of Lohrville

Cease all illegal discharges to waters of the state; submit a compliance plan for approval that contains, at a minimum, the actions to be taken to address the chloride effluent limit violations with corresponding performance dates; and pay a $1,500 administrative penalty.

Fayette County

Randalia Community Sanitary District

Submit a National Pollutant Discharge Elimination System permit application within 60 days and pay a $2,510 administrative penalty.

Hardin County

Resinew, LLC

Develop and implement a plan for the inspection and maintenance of manure application equipment; submit the plan and immediately implement upon approval; pay $3,701.18 in fish restitution and a $4,000 administrative penalty.

Woodbury County

Cargill, Incorporated

Identify compliance stack test date and time, which cannot be changed or cancelled without prior written approval; apply for a modification to its air construction permit to establish monitoring parameters related to moisture of processed beans, requirements for investigation and corrective action if a defined level of solvent loss increases are observed, and to define the calculation method used to calculate the Volatile Organic Compounds Best Available Control Technology Solvent Loss Ratio limit; provide an enforceable schedule for replacing portions of the Boiler 3 Continuous Emission Monitoring System; and pay a $10,000 administrative penalty.

Administrative Orders

Responsible parties have 60 days to appeal the order or 60 days to pay the penalty.
