DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Clinton County

L&M Hogs LLC

Submit a complete Phosphorus Index Manure Management Plan and compliance fee; and pay a $3,000 administrative penalty.

Hancock County

Zinpro Corp.

Submit a plan outlining the steps to prevent future discharges and pay a $5,000 administrative penalty.

Wright County

Gold-Eagle Cooperative

Do not operate the feed mill equipment when control equipment is not functioning and emissions are being vented to the outside atmosphere; maintain and operate its equipment and control equipment at all times in a manner consistent with good practice for minimizing emissions; report excess emissions timely; repair equipment expeditiously to stop excess emissions; submit an as-built air quality construction permit application for equipment installed or modified without the required air quality construction permit; and pay a $10,000 administrative penalty.

Administrative Orders

Responsible parties have 60 days to appeal the order or 60 days to pay the penalty.
