DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Hull County
Boogerd Dairy, Inc.
Comply with the construction permitting requirements in the future; submit an as-built construction permit application and pay the $250 construction permit fee; submit an updated manure management plan (MMP) with all animals in confinement; pay the $250 MMP fee; and pay a $5,000 administrative penalty.
Sac County
AMPC, LLC dba Essentia Protein Solutions
Cease all illegal discharges to waters of the state; comply with all conditions of its National Pollutant Discharge Elimination System permit; comply with all conditions of its operation permit for land application of wastewater; within 60 days submit an engineering report that includes the following: information on the storage capacity of the lagoon, whether the storage capacity is adequate to store wastewater between periods of land application while maintaining the freeboard requirements, a construction schedule detailing the upgrades necessary to comply with the land application of wastewater permit, and an evaluation of the wastewater lines that convey wastewater to the lagoon; and pay a $8,000 administrative penalty.

Cease all illegal open dumping, open burning, and improper solid waste disposal; dispose of all remaining solid waste, including the burn pile ash, on-site and submit receipts proving proper disposal at a landfill or recycling facility; and pay a stipulated $5,000 administrative penalty.
Winneshiek County

Provide a professional engineer report on the facility's manure storage capacity; rework and maintain the grass waterway to prevent any processed wastewater and manure runoff from entering the tile intake; develop and implement a plan for the maintenance of the open feedlots, in particular how manure will be removed and stored; pay $33,470.39 in fish restitution and investigation costs; and pay a $5,000 administrative penalty.
