DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Emmet County

Jeff Ulrich

Pay a $3,000.00 administrative penalty.

Hancock County

Zinpro Corporation

Submit for approval a maintenance plan for EP 13 equipment and control equipment; obtain a modified construction permit for EP 13 to: add annual stack testing requirements for particulate matter, particulate matter 10, volatile organic compounds, and hazardous air pollutants; restrict the production of the Availa Cu product; increase the single hazardous air pollutant rate to addressed the formaldehyde emission limit exceedances; add control equipment monitoring parameters; and pay a $10,000 administrative penalty.

Howard and Mitchell Counties

City of Riceville

Complete construction of wastewater treatment facility upgrades by November 2026 and pay a $5,000 administrative penalty.

Iowa and Poweshiek Counties

J.W. Construction Company, LLC

Immediately discontinue illegal open burning and illegal solid waste disposal and pay a $3,000 administrative penalty (via a 4-part payment plan).

Administrative Orders

Responsible parties have 60 days to appeal the order or 60 days to pay the penalty.
