DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Benton County
Genosource, LLC
Pay a $6,000 administrative penalty.
Clarke County
City of Osceola
Comply with all terms of its National Pollutant Discharge Elimination System (NPDES) permit; conduct an Industrial Waste Survey to identify industries that may be contributing to elevated pollutants in the publicly-owned treatment work's influent; complete construction of the publicly-owned treatment facility's upgrades that are necessary to comply with final effluent limitations contain in the NPDES permit; submit biannual reports on construction activity until final construction is complete; and pay a $6,000 administrative penalty, with a portion of the penalty amount paid as a supplemental environmental project to the Clarke CCB.

Midwest Holstein Feeders, LLC
Comply with the construction permitting requirements in the future and pay a $3,500 administrative penalty.
