DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Allamakee County

Four County Crop Service, Inc. 

Cease all illegal discharges to waters of the state; submit a written plan detailing procedures for cleaning secondary containment structures, storage tanks, and equipment, and on how to properly dispose of wastewater; have staff sign an acknowledge of training on the new plan; and pay a $6,000 administrative penalty.

Cass County

Vision Atlantic, Inc.

Cease all illegal discharges to waters of the state; comply with all conditions of its National Pollutant Discharge Elimination System permit; and pay a $8,000 administrative penalty.

Lyon County

Ferdsons Family Farms, Inc.

Pay a $3,000 administrative penalty.

Polk County

Knapp Properties, L.C. d/b/a Knapp Properties

Cease all illegal discharges to waters of the state; comply with all conditions of its National Pollutant Discharge Elimination System permits; and pay a $5,500 administrative penalty.

Washington County

Keith Miller

Be properly certified before handling, transporting, and applying manure; and pay a $3,000 administrative penalty.

Administrative Orders

Responsible parties have 60 days to appeal the order or 60 days to pay the penalty.

Chickasaw County

Walter, LLC

Submit a complete Iowa Phosphorous Index Manure Management Plan and annual compliance fee; and pay a $3,000 administrative penalty.
