DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Howard County

Kenneth Moellers

Comply with construction permitting requirements and pay a $5,000 administrative penalty.

Winneshiek County

Roger and Joan Egeland and Dale and Marcia Monroe

Submit a written plan detailing how the silage runoff will be managed at the facility and immediately implement upon approval; and pay $2,088.62 in fish restitution; pay a $7,000 administrative penalty, with $5,250 of the penalty paid as a Supplemental Environmental Project to the Winneshiek County Conservation Board.

Submit the 2024 and 2025 manure management plan updates and $120 annual compliance fee for both years; and pay a $4,000 administrative penalty.
