DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Washington County

Matthew Jacoby

Voluntarily surrender wastewater and water treatment certifications and refrain from seeking recertification until after July 1, 2027; and do not perform any shift operator or operator-in-charge responsibilities until and unless recertified.

Webster County

Mark George

Voluntarily surrender water treatment and water distribution certifications and refrain from seeking recertification until after July 1, 2027; and do not perform any shift operator or operator-in-charge responsibilities until and unless recertified.

Administrative Orders

Responsible parties have 60 days to appeal the order or 60 days to pay the penalty.

Marion County

Dustin Nichols

Immediately cease allowing, causing, or permitting the unlawful open burning of combustible material on-site; comply with all laws and regulations regarding open burning and solid waste disposal, including the collection, damage, storing, and disposing of waste appliances on-site; properly dispose of all non-recyclable solid waste on-site and submit disposal receipts from a lawfully operating landfill; and pay a $5,000 administrative penalty.
