DNR enforcement actions

DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Buchanan County
Buchanan County Fair Association dba Buchanan County Fair & Livestock Association
Cease all illegal solid waste disposal and all illegal open burning, remove all remaining solid waste and dispose of it at a landfill, submit landfill receipts, provide notice and training for members regarding solid waste and open burning regulations, place and maintain signs prohibiting illegal solid waste disposal and illegal burning, and pay a $4,500 administrative penalty.

Crawford County
Eric & Hannah Heiman
Comply with animal feeding operation rules in the future and pay a $1,500 administrative penalty.

Worth County
New Heaven Chemicals Iowa, LLC
Create an enforceable compliance plan, provide quarterly updates, and if the company is sold, the new owner will be notified of compliance plan.

 

Administrative Orders
Responsible parties have 30 days to appeal the order or 60 days to pay the penalty.

Mahaska County
J.S. Properties, L.L.C. and Terry Anderson
Amendment to Administrative Order 16-AQ-12. Amended the penalty and closed the order.

Muscatine County
CHS, Inc.
Submit 2018 MSEI and pay a $6,000 administrative penalty.
