DNR enforcement actions

DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party. 

Poweshiek County
Jim Knoblauch
Cease open dumping of solid wastes and pay $2,000 penalty. 

Wappello County
James D. Olchefski and Robert Nicholson, dba Hidden Valley Mobile Home Park
Consent Amendment to Administrative Order No. 2016-AQ-20/2016-SW-14:  Pay $5,000 penalty and submit Plan of Action detailing steps to be taken when demolishing trailers at mobile home park. 

Administrative Orders

Responsible parties have 30 days to appeal the order or 60 days to pay the penalty.

Sac County
Michael Maccumber
Submit complete manure management plan and overdue fees and pay $10,000 penalty for history of noncompliance with Iowa's manure management plan requirements.

Winnebago County
Gary Roemhildt
Comply with asbestos NESHAP requirements, properly manage all remaining asbestos containing material, and pay $10,000 penalty for asbestos removal violations at the old Rake School Building.
