Chapter 135 Revisions from Dec. 17 Meeting
Attached please find the proposed Chapter 135 Revisions
submitted to EPC for Information. A list of key changes resulting from the
December 17 stakeholder meeting is shown below:
- Synergistic effects
of mixed contaminants and vocabulary related to that issue were removed from
the proposed rules as these were complicated to address and need further
discussion.
- The phrase “or other sensitive material” was removed from the proposed rule.
If other materials are found to be susceptible to petroleum, these will be addressed
with rule changes.
- The Ten States Standard was removed from reference as this particular standard could
change in time.
- Action levels were revised to include those calculated by ISU, and which were previously
circulated to the group and discussed at the stakeholder meeting.
- Conditions that might necessitate requirement of soil confirmation sampling were added.
- We added notification requirements that as soon as a potential impact to a water line is known,
the water supply must be notified.
- An addendum was added to Appendix B to include a description of how each action level in the Tier
1 Look-Up Table was calculated. This is in process pending completion

stakeholder meetings and public hearings as this process moves forward.
