The DNR has taken the following enforcement actions. The following are only briefs; copies of enforcement actions, including the full, original orders and contact information, are available on the DNR’s website at www.iowadnr.gov/InsideDNR/AboutDNR/EnforcementActions.aspx.
Responsible parties have 30 days to appeal the order or 60 days to pay the penalty.
Black Hawk County
Quality Mat Co., Inc., Waterloo
Pay $3,000 penalty for failure to timely submit Minor Source Emission Inventory (MSEI) for 2012. Stipulated penalties also included if MSEI is not submitted per the order.
Cease illegal disposal of solid waste and pay $5,000 penalty.
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Royal Oaks Development Corporation and AJ Spiegel, Peosta
Cease illegal solid waste disposal activities and pay $8,000 penalty.
Cease illegal open burning of solid waste and pay $750 penalty.
Dennis Huedepohl, dba Breckenridge Estates Mobile Home Park, Iowa City
Cease illegal open burning and open dumping of solid wastes, properly dispose of remaining solid waste, and pay $5,000 penalty.
Dairy Venture LLC
Pay $3,000 penalty and $873 in investigative costs to resolve violations resulting from a manure discharge that resulted in water quality violations and a fish kill. Note: $421 in fish restitution and investigative costs has already been paid. The penalty has been paid.
Corey DeRocher, dba DeRocher Brothers Farms
Pay $2,000 penalty and agree to land apply manure in a manner that complies with Iowa law.
Van Buren County
Barker Specialty Products, LLC, Keosauqua
Comply with all conditions of National Pollutant Discharge Elimination System General Permit No. 1 and pay $3,000 penalty for past violations of storm water permit.
Prairie Valley Farm Service, LLC
Cease illegal open dumping and open burning of solid wastes, properly remove remaining solid waste from the site, and pay $4,000 penalty.
Western Iowa Telephone Association (A Cooperative)
Cease illegal discharges to waters of the state, comply with all conditions of storm water permit, and pay $4,000 penalty.
A consent amendment is issued in settlement of a previous administrative order or to amend a pre‐existing consent order. A consent amendment indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Des Moines County
Joseph Skelley and Ssippi Valley Saloon, LLC, Burlington
Pay $2,000 penalty to settle appeal of original 2013 order regarding air quality violations. The penalty has been paid.
City of Indianola
Terminates 2009 order to acknowledge compliance to date with provisions of order and to terminate the one continuing requirement which would otherwise remain in effect.
