DNR Enforcement Actions

DES MOINES — The DNR has taken the following enforcement actions. The following are only briefs; copies of enforcement actions, including the full, original orders and contact information, are available on the DNR’s website at

Administrative Orders
Responsible parties have 30 days to appeal the order or 60 days to pay the penalty.

Des Moines County
Joseph Skelley and Ssippi Valley Saloon, LLC, Burlington
Conduct required asbestos inspection on building and pay $3,300 penalty for past asbestos violations.

Iowa County
J&J Pork, L.L.C.
Pay $5,000 penalty for manure management plan violations. The order has been appealed.

Mahaska County
Robert Downing, University Park
Properly remove all discarded appliances, other recyclable materials and solid waste from property and pay $10,000 penalty.

Consent Orders
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Cerro Gordo County
Golden Grain Energy, LLC, Mason City
Pay $10,000 penalty and $650 in wildlife restitution for past discharges at facility. Company also agrees to implement facility-wide environmental management system.

Fayette County
City of Clermont
Cease illegal discharges to waters of the state, complete construction of wastewater treatment facility improvements, and pay $3,500 penalty.

Linn County
City of Cedar Rapids
Pay $8,469 in fish restitution for past wastewater violations.  City also to pay $1,500 to Linn County Conservation Board as a supplemental environmental project.

Louisa County
Russell Miller, dba Woodland Mobile Home Park, Wapello
Comply with wastewater requirements and pay $10,000 penalty for wastewater violations.

Consent Amendments
A consent amendment is issued in settlement of a previous administrative order or to amend a pre‐existing consent order. A consent amendment indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Harrison County
Kenneth Kline
Amends a 2012 administrative order. Evaluate facility and implement improvements, if necessary, to ensure open feedlot complies with state law, and pay $3,000 penalty.
