Notification Deadline for Utility NESHAP is August 14, 2012

Owners and operators of electric utility steam generating units (EGU) are reminded of an upcoming deadline for submittal of an initial notification for the federal air toxics standards for coal and oil fired EGUs. 

On February 16, 2012, EPA finalized the NESHAP for Coal and Oil-Fired Electric Utility Steam Generating Units (40 CFR 63 Subpart UUUUU, also called the “Mercury and Air Toxics Standards (MATS)” or “Utility NESHAP”).

The Utility NESHAP applies to all facilities that own or operate a coal-fired EGU or an oil-fired EGU, as defined in the federal rule (40 CFR 63.10042), regardless of whether the facility is a major source or an area source of HAP emissions. This rule does not apply to natural gas-fired EGU.

Facilities with existing EGU (construction of EGU commenced on or before May 3, 2011) that are subject to the federal rule are required to submit an initial notification to EPA no later than August 14, 2012. On August 2, 2012, EPA issued a stay on the federal rule requirements that apply to new EGU (construction or reconstruction of EGU commenced after May 3, 2011). This stay does not affect the requirements for existing EGU.

At this time, Iowa has not adopted the Utility NESHAP. Because the state has not adopted the Utility NESHAP, facilities are required to send their initial notifications to EPA Region VII. Since Iowa may adopt this NESHAP in the future, the Iowa Department of Natural Resources (DNR) is requesting as a courtesy that facilities also send copies of any notifications to the DNR. The DNR plans to seek stakeholder input on adopting this NESHAP.
