Initial Notification Requirement for Major Source Boiler MACT

On January 31, 2013, EPA published in the Federal Register amendments to the National Emission Standards for Hazardous Air Pollutants (NESHAP) for boilers and process heaters at major sources (40 CFR 63 Subpart DDDDD, also called the “Major Source Boiler MACT” or Maximum Achievable Control Technology).

The Major Source Boiler MACT applies to boilers and process heaters located at major source facilities. A major source is a facility with potential or actual emissions of 10 tons per year or more of any single hazardous air pollutant (HAP) or 25 tons per year or more of all HAP combined.
 

Initial Notification Requirement

 

Facilities with boilers or process heaters that are subject to this federal rule are required to submit an initial notification. If the startup date of the affected unit was before January 31, 2013, the initial notification must be submitted no later than May 31, 2013. If the startup date of the affected unit was after January 31, 2013, the initial notification must be submitted no later than 15 days after startup.

 

Facilities that already submitted an initial notification for the Major Source Boiler MACT promulgated on March 21, 2011, are not required to submit another initial notification at this time. Facilities that have not submitted an initial notification since the “old” Boiler MACT (promulgated in 2004) will need to submit a new notification.

Because the DNR does not currently have delegation of the Major Source Boiler MACT, facilities are required to send their initial notifications only to EPA Region VII. Since Iowa may adopt this NESHAP in the future, we are requesting as a courtesy that facilities also send copies of their initial notifications to the DNR.
