Responsible parties have 30 days to appeal the order or 60 days to pay the penalty.
Jon Olson, Pomeroy
Cease all illegal solid waste disposal activity and all illegal open burning of combustible materials and pay $4,263 penalty.
Michael Lee Liphardt, aka Melvin Liphardt, De Witt
Comply in the future with the state’s burning and solid waste disposal laws, remove and properly dispose of materials remaining at the site, and pay $3,000 penalty for past open burning and open dumping violations.
Cease illegal burning and disposal of solid waste and pay $1,500 penalty. The penalty has been paid.
Plymouth Oil Company, LLC, Merrill
Timely submit wastewater monthly operation reports.
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Abens Ag & Construction, Inc., Pomeroy
Cease all illegal solid waste disposal and illegal open burning activities and pay $2,500 penalty.
Cease improper open dumping and open burning of solid wastes and pay $2,500 penalty.
City of Mondamin
Construction schedule for wastewater treatment facility improvements and payment of $3,000 penalty.
Wellman Dynamics Corporation
Establish a schedule for company to return to compliance with the financial assurance requirements associated with operating an industrial landfill. Stipulated penalties included.
A consent amendment is issued in settlement of a previous administrative order or to amend a pre‐existing consent order. A consent amendment indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Pay $1,350 penalty for past violations. The penalty has been paid.
Thomas Chris Dodge, Parnell
Amendment to compliance schedule to resolve violations related to the illegal stockpiling of waste tires.
Mid River Marine Service and Storage, Inc., North Liberty
Revised compliance schedule and payment of $8,720 penalty. A portion of the penalty ($4,220) is waived if schedule contained within the order is met.
City of Marshalltown
Changes to Marshalltown’s construction schedule for sanitary sewer improvements.
Muscatine Used Parts, Inc., Muscatine
Amendment to clarify that Muscatine Used Parts, Inc. may collect discarded appliances on behalf of a permitted appliance demanufacturer.
City of Dixon
Revised compliance schedule to correct nitrate issues. Dixon's public water supply will be sold to Iowa-American Water Company and new well will be installed. City agrees to pay $2,500 penalty and dismiss appeal of original order.
