Responsible parties have 30 days to appeal the order or 60 days to pay the penalty.
Black Hawk County
Nazareth Evangelical Lutheran Church, Cedar Falls
Submit past due monthly operation reports (MORs) and pay $3,000 penalty for MOR violations.
Massey Properties, LLC, dba The Wharf, Dubuque
Comply with state standards for this public water supply and pay $10,000 penalty for violations.
Install facility improvements and abide by other restrictions on facility operation, and pay $10,000 penalty. The order has been appealed.
Mid River Marine Service and Storage, Inc., North Liberty
Comply with water supply requirements and pay $8,720 penalty.
B Petro Corporation, Cedar Rapids
Comply with state underground storage tank standards and pay $7,728 penalty for existing violations.
Anderson Excavating Company, Inc.
Resolve compliance issues at the company’s construction and demolition landfill and pay $10,000 penalty. The order has been appealed.
City of Dixon
Comply with state standards for nitrate for this public water supply and pay a $9,500 penalty for failure to correct nitrate MCL violations.
Meyer & Hamann Excavating, Inc., Dixon
Cease illegal solid waste disposal and open burning of solid wastes, properly remove the remaining materials from the site, and pay $9,920 penalty.
Sun-Jon, Inc., Kalona
Requirement to submit complete application for renewal of wastewater operation permit and pay $3,000 penalty. Company is prohibited from land application of wastewater until such time as renewed permit has been issued.
City of Fort Dodge
Provide backup power supply for wells and water treatment plant and pay $10,000 penalty. The order has been appealed.
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
L&W Quarries, Inc., Mystic
Pay $5,300 penalty for violations of air quality construction permit.
Noah Coppess, Stanwood
Comply in the future with regulations concerning proper disposal of solid waste, open burning, and asbestos compliance; remove all remaining solid waste from property and properly dispose of it; and pay $7,500 penalty.
Snittjer Grain Company, Inc., Wellsburg
Pay $10,000 penalty to resolve violations pertaining to illegal open burning of solid wastes.
PLCP, LLLP, aka Pine Lake Corn Processors, LP, Steamboat Rock
Pay $10,000 penalty for past air quality construction permit violations.
City of Reasnor
Comply with construction schedule for wastewater treatment facility improvements, properly operate and maintain existing wastewater collection and treatment facilities, and pay $1,500 penalty.
Thombert, Inc., Newton
Pay $4,851 penalty for past air quality recordkeeping violations at facility.
61 Park LLC, dba Maplewood Estates
Pay $3,000 penalty for NPDES permit effluent limit violations.
A separate consent order sets out the schedule needed to upgrade the wastewater treatment facility in order to comply with effluent limitations. The order includes stipulated penalty provisions.
Joint Use of Sanitary Sewers and Sewage Disposal Facilities: Davenport, Bettendorf, Riverdale and Panorama Park
Schedule for necessary upgrades to the Davenport Water Pollution Control Plant and the wastewater collection systems of Davenport and Bettendorf to achieve compliance with applicable requirements and to eliminate the discharge of untreated wastewater from the collection systems.
Sterling Woods Homeowners Association, Inc.
Pay $3,000 penalty for past violations of DNR’s water supply requirements. $1,500 of penalty amount may be paid as a supplemental environmental project (SEP) to Scott County Conservation Board. The penalty and the SEP have been paid.
A consent amendment is issued in settlement of a previous administrative order or to amend a pre‐existing consent order. A consent amendment indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Des Moines County
June Oyer, Parsons Diehl, LLC, Burlington
Amends a 2011 administrative order to: properly close wastewater treatment facility at Plantation Village Mobile Home Park and pay $2,500 penalty if wastewater treatment facility is not closed by May 1, 2013. This order settles previous administrative appeal.
