Responsible parties have 30 days to appeal the order or 60 days to pay the penalty.
Herum Excavation, L.L.C., Estherville
Pay $10,000 penalty for violations related to the demolition and site clearing of a former motel and mobile home park.
Thombert, Inc., Newton
Maintain records in accordance with air quality construction permit requirements and pay $7,351 penalty.
Finney Industrial Painting, Inc., Fairfield
Submit air quality construction permits for unpermitted air emission sources, submit stormwater permit application, and pay $7,500 penalty.
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Agriland FS, Inc., Casey
Pay fish restitution and investigation costs of $6,258 and a $10,000 penalty for discharge of pollutants to a water of the state.
Dennis Wisecup, dba Wisecup Trucking and Wisecup Iron & Metal, Ogden
Immediately discontinue illegal burning and disposal of solid waste, properly remove any remaining material, obtain any necessary air quality permit for the on-site business and pay $5,500 penalty.
Cerro Gordo County
Golden Grain Energy, LLC, Mason City
Comply with the requirements of its air quality construction and Title V operating permits and pay $5,750 penalty. Of that penalty amount, $4,312 may be paid to the Cerro Gordo County Conservation Board as a supplemental environmental project.
John Kletsch, Superior
Immediately cease improper burning of solid waste, remove all remaining solid waste from the site and dispose of at a licensed sanitary landfill, and pay $3,000 penalty.
Ernest Poyzer, Alan Poyzer, and Dean Poyzer
Cease improper burning and dumping of solid waste, properly remove all remaining solid waste from the site, and pay $3,500 penalty.
Iowa Limestone Company, Alden
Pay $5,000 penalty for violations of air quality recordkeeping and permitting requirements. This order supersedes a 2011 administrative order.
City of Council Bluffs
Develop written plan to respond to emergencies associated with fueling stations and pay $1,000 penalty for underground storage tank violations.
Discontinue improper open burning and open dumping of solid waste, clean up burn area and properly dispose solid waste, and pay $1,500 penalty.
Immediately cease illegal open burning of solid waste and pay a $500 penalty.
