Public Comment Period for the 2008 Ozone State Implementation Plan

The Iowa Department of Natural Resources (DNR) is requesting public comment on the State of Iowa’s state implementation plan (SIP) for the national ambient air quality standards (NAAQS) for ozone.

The SIP has been written to fulfill the requirements of Section 110 of the federal Clean Air Act (CAA). Section 110(a) of the CAA requires each state to adopt and submit a plan for the implementation, maintenance, and enforcement of each NAAQS within 3 years of promulgation to the Administrator of the U.S. Environmental Protection Agency (EPA).

The ozone NAAQS was revised by EPA on March 12, 2008. The level of the standard waslowered from 0.08 parts per million (ppm) to 0.075 ppm per 8-hour average concentration. The EPA’s decision to tighten the standard was based upon the latest review of available scientific information linking health effects to ozone concentrations. On September 16, 2009, EPA announced it would reconsider the standard and delayed the requirement for states to submit a SIP for the new ozone NAAQS. The reconsideration process was halted on September 2, 2011, and EPA instead committed to reviewing and potentially revising the 2008 ozone NAAQS as part of a periodic NAAQS review required by the CAA. The entire state of Iowa is currently designated as unclassifiable/attainment for the 2008 8-hour ozone NAAQS (77 FR 30088).

A public hearing will be held on January 8, 2013, at 1:00 p.m. in the conference rooms at the Iowa DNR’s Air Quality Bureau office located at 7900 Hickman Road, Suite 1, Windsor Heights, Iowa.  All comments must be received no later than January 8, 2013.

Any person who intends to attend the public hearing and has special requirements such as those related to hearing or mobility impairments should contact Wendy Walker at 515-281-6061 to advise of any specific needs.

A responsiveness summary will be prepared by the Iowa DNR following the close of the public comment period. The responsiveness summary will include any written or oral comments received during the public participation process and the Iowa DNR’s response to the comments. The completed responsiveness summary will be forwarded to EPA and made available to the public upon request.
