Financial Assistance and Incentives: Ethanol and Biodiesel

Ethanol-Based Fuels Excise Tax Exemption

Summary: This statute effectively taxes ethanol-blended gasoline at $0.19/gallon and E85 at $0.17/gallon while non-ethanol blended gasoline is taxed at $0.207/gallon. The non-ethanol blended gasoline tax rate may be adjusted annually, depending on the amount of ethanol-blended fuel sold in the preceding calendar year. The E85 tax rate of $0.17/gallon begins on January 1, 2006 and reverts to $0.19/gallon when total annual E85 sales exceed approximately 700,000 gallons. Blenders of conventional motor fuel with ethanol may file for a refund for the difference between excise taxes paid on the motor fuel purchased to produce ethanol-blended gasoline and the excise tax due on the ethanol-blended gasoline.

E85 Infrastructure Installation Grant

Summary: This statute appropriates funds to the Department of Economic Development (DED) to provide a cost-share program for the installation or conversion of infrastructure used by service stations to sell and dispense E85 blended gasoline. It directs DED to provide for at least thirty new or converted E85 retail stations.

Biodiesel Terminal Infrastructure Installation Grant

Tax Credit for High Sales of Ethanol Blended Gasoline

Summary: This gives a tax credit to retail service stations at which more than 60% of the total gallons of gasoline sold and dispensed through one or more metered pumps is ethanol-blended for tax years beginning on or after January 1, 2002. The amount of the tax credit for each eligible service station is two and one-half cents multiplied by the total number of gallons of ethanol blended gasoline sold and dispensed through all metered pumps located at that service station during the tax year in excess of sixty percent of all gasoline sold and dispensed through metered pumps at that service station during the tax year.
