MSW Landfill Expansions May Change Applicability to State Performance Standards

As part of a compliance assistance effort, the Department of Natural Resources (DNR) Air Quality Bureau will mail out determination letters to all active municipal solid waste (MSW) landfills in the state. The letter will help landfills determine their applicability and compliance status with the New Source Performance Standard (NSPS) 40 CFR Part 60, Subpart WWW or Subpart Cc, Title V Operating Permits, and Construction Permits. Subpart WWW became effective March 12, 1996 and Subpart Cc was adopted by the State of Iowa June 22, 1998.

The DNR recently become aware of landfills undergoing expansions to increase their design capacity that may, in turn, make them subject to the performance standards. A short form will be attached to the letter that must be filled out and returned to the AQB within 45 days from receipt.

A “Frequently Asked Questions” document will be sent with the letter to provide guidance on the regulations and permit requirements for MSW landfills.
