Workgroup to Craft Exemptions for Engines Over 400hp

DNR, the Iowa Nebraska Equipment Dealers Association, John Deere, and the Iowa Air Emissions Assistance Program will soon begin work, together with other interested parties, to exempt engines over 400 hp from a long standing requirement to obtain an Air Construction Permit for air pollution emissions. Mobile sources (vehicle tailpipe emissions) and engines under 400 hp are already exempt from the requirement to obtain an Air Construction permit. The workgroup’s goal will be to have an exemption developed by mid-July so that it can be finalized by early this fall.
Newer engines are being built for agricultural implements and construction vehicles that now exceed 400 hp. When those vehicles are being operated on or off road they are not required to be permitted. However, when these vehicles are being serviced at a dealership or garage, their emissions when vented through a vent or stack must be permitted. However, because newer engines have more stringent EPA emissions limits, the DNR believes it is appropriate to look at exempting this equipment from the permitting requirement. In the past DNR has not sought applications for permits for these sources, and will continue to forgo enforcement of this regulatory requirement while the workgroup develops the exemption. DNR reserves the right to follow-up on any complaints that may arise in regard to the operation of these facilities.
