IOWA H2O PROGRAM (PROGRAM) RULES

No purchase, payment or donation is necessary to participate.

  1. BINDING AGREEMENT:  In order to participate in the Program, you must agree to the Rules.  Therefore, please read these Rules prior to registering to ensure you understand and agree.  You agree that submission of an entry in the Program constitutes agreement to these Rules.  You may not submit an entry to the Program and are not eligible to receive the prizes described in these Rules unless you agree to these Rules.  These rules form a binding legal agreement between you and the Iowa Department of Natural Resources with respect to the Program.
  2. ELIGIBILITY:  To be eligible to participate in the Program, an Entrant must:
    1. be a U.S. citizen or permanent U.S. legal resident (i.e. must be able to show proof of legal permanent residence, for example, a “green card”);
    2. be at least 10 years of age; and
    3. have obtained a parent’s or legal guardian’s prior permission if under the age of 18.  (Failure to do so will result in your ineligibility to participate.)

      Employees of the Iowa Department of Natural Resources and their immediate family (defined as spouse and children) are not eligible for any prizes that may be given away as part of the program.
  3. SPONSORS:  This program is sponsored by the Iowa Department of Natural Resources (Sponsor) located at Wallace State Office Building, 502 East Ninth Street, Des Moines, IA 50319.  Prizes awarded under this Program will be provided by various organizations who donate items to the Sponsor to be used in the monthly drawings.  The Sponsor reserves the right to change, alter, or otherwise tailor the Program’s rules at any time.  The Sponsor also reserves the right to withdraw or terminate this Program at any time without prior notice without penalty.
  4. PROGRAM PERIOD:  The Program shall include three periods.  The first period shall run from 12:00 A.M. Central Time on April 22, 2013 to 11:59 P.M. Central Time on July 31, 2013.  The second period shall run from 12:00 A.M. Central Time on August 1, 2013 to 11:59 P.M. Central Time on August 31, 2013.  The third period shall run from 12:00 A.M. Central Time on September 1, 2013 to 11:59 P.M. Central Time on December 31, 2013.  All dates and Program periods are subject to change.
  5. HOW TO PARTICIPATE:  No purchase is necessary to enter or win, and this Program is void where prohibited.  Participate by registering on the Program website and reporting healthy activities as described below.  Registration allows individuals and families to create an account wherein they can document healthy activities done in state parks, recreation areas, forests, preserves, and wildlife areas; on Iowa’s waterways; and in Iowa’s federal-, city- and county- owned or managed parks and conservation areas.  Each activity that is recorded to a participant’s account is an entry for a drawing for a recreation-related prize.  The drawings will occur once during the first Program period, with the winner announced during the 2013 Iowa State Fair; and monthly, on the first business day of the following month, during the second Program period.  Registrants must provide their first name, last name, email address, answer two baseline questions, provide their own 3rd question and a password at least 8 characters long (alphanumeric) that includes at least one special character and a mix of upper and lowercase letters during the initial registration and must provide their birth date, gender, zip code, state and county information to report the healthy activity.  All information provided in the registration and activity reports must be complete and accurate; failure to accurately and completely submit all information may result in your disqualification from participation in the program, including without limitation the winner selection.    
  6. WINNER SELECTION:  Two prizes will be given away by the Sponsor during the first period of the Program, with the winners to be announced during the 2013 Iowa State Fair.  The winners will be selected from the entries received during that first Program period.  If additional prizes are provided by organizations for the first period, drawings shall be held by the Sponsor using the entries received during that Program period and the winners will also be announced during the 2013 Iowa State Fair.  During the second period of the Program, two prizes will be given away by the Sponsor, with the winners selected at random on the first business day of the next calendar month.  During the third period of the Program, one prize will be given away by the Sponsor monthly, with the winner selected at random on the first business day of the next calendar month.  The winner will be selected from those entries received during the prior calendar month. Odds of winning a prize depends on the number of entries received.  The Sponsor shall notify the winners via the e-mail address registered to the participant’s account.  Winners may be required to show identification to claim the prize.  The Sponsor reserves the right to examine additional identification and may choose to accept or deny awarding the prize based on the identification presented.  The Sponsor may withhold the prize for any lawful reason. 
  7. PRIZES: Prizes that are distributed pursuant to this Program shall be provided to the Sponsor from organizations supporting the Program.  Prizes and prize values shall vary based on the donations made to the Sponsor to support this Program, though the Sponsor anticipates the prizes to be items valued at less than $500.  Information about current prizes will be made available on the Program’s website, https://www.iowadnr.gov/healthyhappyoutdoors.aspx, to the extent the information is available.      
  8. TAXES:  Taxes, if any, are the sole responsibility of the winner.
  9. OTHER TERMS AND CONDITIONS:  By participating in the program each participant and winner waives any and all claims of liability against the Sponsor, any organizations donating prizes or otherwise affiliated with sponsoring the Program, and their employees and agents, for any personal injury or loss that may occur from the conduct of, or participation in the contract or from the use of any prize.  By claiming the prize, the winner authorizes the use, without additional compensation, of his or her name and/or likeness and/or voice/photograph and municipality of residence for promotion and/or advertising purposes in any manner and in any medium (including, without limitation, radio broadcasts, newspapers and other publications, television or film releases, slides, videotape, distribution over the Internet, and picture date storage) the Sponsor may deem appropriate.
  10. PUBLIC RECORDS:  All information provided by participants shall constitute a public record and shall be treated accordingly pursuant to Iowa Code chapter 22. 
  11. IMMUNITY FROM LIABILITY.  You are hereby notified and agree that the Iowa Department of Natural Resources is immune from liability and suit for your participation in this program; including your participation to the extent it affects third parties thereby.
  12. DISPUTES.  The laws of the State of Iowa shall govern and determine all claims and matters against involving the Iowa Department of Natural Resources arising out of or in connection with your participation in the program without regard to the choice of law provisions of Iowa law. In the event any proceeding of a quasi-judicial or judicial nature is commenced against or involving the Iowa Department of Natural Resources in connection with your participation in the Program, the exclusive jurisdiction for the proceeding shall be brought in Polk County District Court for the State of Iowa, Des Moines, Iowa, or in the United States District Court for the Southern District of Iowa, Central Division, Des Moines, Iowa wherever jurisdiction is appropriate. This provision shall not be construed as waiving any immunity to suit or liability, including without limitation sovereign immunity in State or federal court, which may be available to the Iowa Department of Natural Resources or the State.
