UST Administrative Rules

The Underground Storage Tank (UST) section is governed by the Iowa Administrative Code (IAC). 

Chapter 134 is divided into Parts A (Certification of Groundwater Professionals), B (Certification of UST compliance Inspectors), and C (Licensing of UST Professionals) to aid the reader in finding these specific sections.

Unstaffed UST Facilities with Pressurized Delivery

On December 18, 2012, the Environmental Protection Commission (EPC) approved and adopted an amendment to Chapter 135, “Technical Standards and corrective Action Requirements for Owners and Operators of Underground Storage Tanks, Iowa Administrative Code.  The amendment addresses leak detection at unstaffed UST facilities (Cardtrol sites) with pressurized delivery.   

The amendment rescinds paragraph 135.5(1)”e” (pressurized delivery for UST systems with no onsite personnel) and adopts a new paragraph, which changes the compliance date from January 1, 2013 to January 1, 2014.  The extension gives owners and operators additional time to comply with the rule and allows the DNR’s UST Section time to work with stakeholders to address concerns that have been raised over the past few months.  The rule becomes effective December 19, 2012.   

The amendment was filed both as an Emergency Rule and a Notice of Intended Action.  This allows the rule to become effective immediately upon filing but also provides for public comment.  A public hearing will held February 7, 2013 at 1:30 in the West 5th floor conference room, Wallace State Office Building, 502 E 9th St, Des Moines  50319.  Written comments must be submitted by February 6, 2013 to Director Chuck Gipp, c/o Paul Nelson, Department of Natural Resources, Wallace State Office Building, 502 East 9th Street, Des Moines, IA 50319; fax (515) 281-8895.  The public hearing is for this amendment only, which changes the compliance date for the above from January 1, 2013 to January 1, 2014.  Stakeholder meetings to discuss concerns of this rule will be scheduled at a later date.
