LUST Trust Fund Project

The Iowa Department of Natural Resources (DNR), in partnership with the US Environmental Protection Agency (EPA), is soliciting proposals from qualified Contractors to provide the services necessary to complete the objectives of the LUST Trust Fund Project (Project).
 
The DNR has identified a group of leaking underground storage tank (LUST) sites located in Iowa where permanent UST closure, soil excavation, longer term remediation, monitoring or other site cleanup activities are desirable or where site assessment is necessary to assign a risk classification and determine what further corrective action is necessary to classify the site as ‘No Action Required’ under application of DNR rules, 567—Chapter 135 (455B) of the Iowa Administrative Code.  The current owner of the property may be unable or unwilling to complete the necessary activities due to the costs.  The owner/operator of the USTs or other responsible party may also be unknown or unavailable.  The Project will be funded through a federal grant, provided by the EPA with emphasis on monitoring activities.

Two Contractors will be selected for the Iowa LUST Trust Fund Project.  The Contractors will be selected based upon their technical qualifications, their demonstrated ability to complete similar project work quickly and on schedule, and upon the proposed costs submitted for each of the activities identified.  The DNR in its sole discretion will select and assign projects to the Contractors retained pursuant to this RFP. Prior to any work being approved for any individual site, a site-specific budget will be negotiated and must be pre-approved based upon the services necessary at each site.  Contractors will only be requested to conduct activities at sites within the Project.   Additional sites, however, may be added to the list identified in the RFP.  

The DNR intends to award two contracts to two separate Contractors.   Each contract shall be for the amount not to exceed $100,000 for duration of one year. DNR shall have the sole option to extend each Contract for five (5) subsequent one-year periods, adding up to no more than six years total for the life of the contract.  The purpose of the five (5) potential one-year extensions is to utilize additional federal EPA LUST Trust funds should such funds be granted to the DNR for corrective action at approved LUST sites.  (However, at this time, the DNR has secured $100,000 for a one-year period). Each one-year extension shall be for the amount not to exceed $100,000 for a total amount not to exceed $600,000 for the life of the contract.  Any Contractor-specific contract resulting from the RFP shall not be an exclusive contract.  

Contractors interested in being considered for the Project must submit a written mandatory Letter of Intent to Propose by November 23, 2011 to Karen Anderson, Issuing Officer, Underground Storage Tank Section, Department of Natural Resources, 502 East 9th Street, Des Moines, Iowa  50319-0034.  Electronic mail and faxed letters will not be accepted.

Completed bid proposals must be received by the issuing officer no later than December 28, 2011, 3:00 pm to be considered.  Electronic mail and faxed proposals will not be accepted.


The DNR shall not discriminate against any Contractor or its employees because of race, creed, color, religion, sex, national origin, age, gender identity, gender orientation, pregnancy, family status, marital status or mental or physical disability in the solicitation of proposals and implementation of the LUST Trust Fund Project.  

All Contractors will be required to comply with the President’s Executive Order No. 11246.  Requirements for Contractors and contractors under this order are explained in the specifications. This project is funded through the US Environmental Protection Agency.  Any Contractors, consulting firms, contractors, subcontractors or suppliers whose firm, affiliate or employees are listed on the GSA List of Parties Excluded from Federal Procurement and Nonprocurement Programs will be prohibited from the contracting process.  Anyone submitting a proposal whose firm, affiliate or employees are listed on the GSA List of Parties Excluded from Federal Procurement and Nonprocurement Programs will be determined to have an ineligible proposal in accordance with Subpart C of 2 CFR Part 180, as implemented by, 2 CFR Part 1532 and 40 CFR 30.13.    

A Contractor’s term and condition that its firm or affiliate, employees, contractors, subcontractors or suppliers are not listed on the GSA List of Parties Excluded from Federal Procurement and Nonprocurement Programs shall be contained in the proposal; however, this term and condition should not preclude any interested party from ascertaining whether the person or firm is actually listed in the GSA List of Parties Excluded from Federal Procurement and Nonprocurement Programs.  The Contractor may access the Excluded Parties List System at http://www.epls.gov
