Responsible parties have 30 days to appeal the order or 60 days to pay the penalty.
Black Hawk County
Nazareth Evangelical Lutheran Church, Cedar Falls
Submit complete application for renewal of NPDES permit to DNR and pay $1,500 penalty.
David Hansen/Debra D. Imhoff
Conduct remedial measures to remove illegal deposits and obstructions in floodplain and pay $10,000 penalty.
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Pattison Sand Company, LLC
Complete application for a sovereign lands permit to the DNR for the removal of accumulated material and restoration of the affected area to the condition that existed before the commencement of the unauthorized activity and pay $10,000 penalty.
Kyle Pattison Tire Company LLC
Order resolves issues related to the historic accumulation of waste tires in a facility owned by Pattison Tire Company.
Develop plan to prevent future manure releases and pay $7,955 in fish restitution and investigation costs and a $4,875 penalty.
Gansen Pumping, Inc. and James Decker
Pay $2,566 in fish restitution and investigative costs and a $6,400 penalty for a manure discharge from the land application of manure.
Pay $16,123 for fish restitution and investigation costs and pay $1,000 penalty for manure discharge resulting in a fish kill.
Pay $2,500 penalty for late submittal of manure management plan.
Hollis Jeffrey, Richland
Properly remove remaining solid waste from property and pay $1,000 penalty for open burning and open dumping violations.
Doug Harrington, Harvey
Immediately cease open burning and open dumping of solid waste and pay $1,500 penalty.
Pay $1,500 penalty for late submittal of manure management plan.
Southern Helicopter Service, Inc., Wilton
Pay $5,972 for fish restitution and investigation costs for pollution incident resulting in a fish kill.
City of Altoona
Pay $500 penalty and $7,676 in fish restitution and investigative costs related to a wastewater discharge and fish kill.
Murphy Oil USA, Inc., Altoona
Conduct and document underground storage tank inspections related to secondary containment and release detection, pay a $6,000 penalty and pay stipulated penalties for any specified future violations.
Comply with order to ensure proper management of manure at facility and pay $3,000 penalty.
City of Sioux City
Pay $10,000 penalty for the demolition and disposal of a building containing asbestos in noncompliance with asbestos regulations.
A consent amendment is issued in settlement of a previous administrative order or to amend a pre‐existing consent order. A consent amendment indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Cedar Valley Farms, LLC
Amends a 2012 order to update operations at the facility.
Anthony Fehr and ACL Fehr LLC
Pay $2,000 penalty for manure management plan violations. Amends a 2011 order.
Country Tavern, Inc., dba The Catfish Place, Nichols
Rescinds a 2012 administrative order regarding water supply issues. Based on records of persons served at the restaurant in recent years, the facility is not a public water supply. This resolves the appeal of the previous order.
