Requesting Public Input for Rule Making on Informal Compliance and Enforcement Options

The Iowa Department of Natural Resources (DNR) is requesting public input on an upcoming rule making effort. The purpose of the rule making is to affirm the variety of informal compliance and enforcement options the DNR may consider in responding to possible violations of environmental statutes, rules, permits, licenses, certifications, and plans.

The DNR has used these or similar procedures for many years, and this rule making simply intends to formalize this practice. The DNR is proposing a new administrative rules chapter, Chapter 9A: Compliance and Enforcement Procedures. The DNR will collect suggestions or comments from the public regarding the proposed rule making until Friday, November 18, 2011.*

The DNR also invites the public to participate in an informational meeting on November 10 or November 17 to learn more about the proposed rule making. At these meetings, DNR staff will make brief introductory remarks, followed by a question and answer session. DNR staff will also collect suggestions or comments from the public regarding the proposed rule making. The public may attend either meeting in person or by conference call. Details on the information meetings are provided below.

Informational meeting on proposed rule making (new Chapter 9A: Compliance and Enforcement Procedures)
When: Thursday, November 10, 2:00 p.m. to 3:00 p.m. This meeting follows the Client Contact Meeting.

*The DNR is requesting public input on this rule making effort prior to beginning the formal rulemaking process and before presenting the proposal to the Environmental Protection Commission. If the DNR receives approval to proceed, there will be further opportunities for public input. Additionally, the DNR will provide a formal public comment period of at least 30 days upon publication of the proposed rule making in the Iowa Administrative Bulletin.
