Responsible parties have 30 days to appeal the order or 60 days to pay the penalty.
Adam Timmerman, dba AT Livestock Ent
Pay $2,500 penalty for late submittal of manure management plan update with Iowa Phosphorus Index.
Steve Friesth, Fort Dodge
Pay $10,000 penalty for open burning and open dumping of solid wastes.
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Cerro Gordo County
Jeff Brakke and Brakke Imp., Inc., Mason City
Discontinue improper open dumping and open burning of solid waste, develop waste management plan, and pay $3,208 penalty.
John and Linda Moons, dba Dalarna Farms Partnership
Pay $5,000 penalty for failure to obtain construction permit prior to construction of animal feeding operation structure.
Pay $2,000 penalty for late submittal of manure management plan.
City of Marengo
Cease improper burning and dumping of solid waste and pay $1,000 penalty.
Mary Kruse and Kruse Brothers Ltd.
Submit a complete manure management plan update with an Iowa Phosphorus Index and compliance fees and pay $5,000 penalty.
Meller Excavating & Asphalt, Inc., Fort Madison
Cease illegal open dumping and open burning of solid wastes and pay $10,000 penalty.
United Farmers Coop, George
Pay $5,000 penalty and $1,707.92 in fish restitution and investigative costs for liquid nitrogen fertilizer release into waters of the state.
Penn Avenue Farms, Inc.
Obtain wastewater operation permit prior to further land application of wastewater and pay $3,000 penalty.
Pilot Travel Centers LLC, Atalissa
Pay $1,500 penalty for spill reporting violations.
Palo Alto County
Paul and Jon Ehmen
Pay $4,500 penalty for manure discharge to a water of the state.
Central Cable Contractors, Inc.
Pay $7,000 penalty for illegal discharge of pollutants to water of the state.
City of Ottumwa
Establishing an enforceable schedule for eliminating and/or reducing the effects of combined sewer overflows and sanitary sewer overflows in the city.
South Central Coop, Lacona
Pay $16,470 in fish restitution and investigative costs for 2010 anhydrous ammonia release.
Trinity Regional Medical Center, Fort Dodge
Pay $1,000 penalty for failure to timely obtain air quality construction permits.
A consent amendment is issued in settlement of a previous administrative order or to
amend a pre‐existing consent order. A consent amendment indicates that the DNR has
voluntarily entered into a legally enforceable agreement with the other party.
Preston White, Aredale
Settlement of earlier appeal – Mr. White agrees to no longer use his well as source of drinking water for nearby establishment (Grandmas Snack Shop). Administrative penalty and fees assessed by earlier order are rescinded as they apply to Preston White.
