DES MOINES — The DNR has taken the following enforcement actions. The following are only briefs; copies of enforcement actions, including the full, original orders and contact information, are available on the DNR’s website at www.iowadnr.gov/InsideDNR/AboutDNR/EnforcementActions.aspx.
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Hamilton and Wright counties
Iowa Select Farms, L.L.P.
Complete improvements at facilities in Hamilton and Wright counties and pay $7,000 penalty.
Winding Creek Coop
Require all manure applicators, handlers and transporters to be properly certified and pay $1,500 penalty.
Titan Machinery, Inc.
Pay $3,500 penalty for illegal disposal, including the illegal open burning of solid waste from company’s Avoca dealership.
Pay $500 penalty for open burning of solid waste, including waste tires.
Phillip Hooyer, dba Natural Fertilizer Company
Obtain proper manure applicator certification for business and all employees engaged in the practice of hauling and applying manure. Pay $4,500 penalty.
A consent amendment is issued in settlement of a previous administrative order or to amend a pre-existing consent order. A consent amendment indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Eastern Hills Baptist Church, Council Bluffs
Amendment to a 2010 administrative order resolves an earlier appeal of the order. Pay $1,250 penalty for water supply violations and $125 in fees.
