EPA Publishes Proposed Utility MACT/NSPS - Comment Deadline July 5, 2011

EPA published in the Federal Register on May 3, 2011, the proposed National Emission Standards for Hazardous Air Pollutants (NESHAP) for coal and oil fired electric utility steam generating units (EGUs), also known as the “Utility MACT.”  EPA concurrently published proposed revisions to the New Source Performance Standards (NSPS) for fossil fueled EGUs and large and small industrial-commercial-institutional steam generating units. EPA originally announced the proposals March 16, 2011. The publication in the Federal Register begins the 60-day public comment period on the rule, which closes on July 5, 2011.

To see the proposal in the Federal Register, go to edocket.access.gpo.gov/2011/pdf/2011-7237.pdf. The proposal provides the EPA contact information and the instructions for providing public comment. EPA announced that it will hold three public hearings on the proposal on May 24, 2011 in Chicago and Philadelphia and on May 26, 2011 in Atlanta.

The public may provide comments electronically and can access documents and correspondences associated with these proposals by going to http://www.regulations.gov/. Enter the EPA docket number in the “Key Word” search. 
For the Utility MACT, use docket number EPA–HQ–OAR–2009–0234. 
For the NSPS, use docket number EPA–HQ–OAR–2011–0044.

Currently, EPA is under a court-ordered consent decree to issue the final Utility MACT by November 16, 2011.
