DNR Enforcement Actions

DES MOINES — The DNR has taken the following enforcement actions. The following are only briefs; copies of enforcement actions, including the full, original orders and contact information, are available on the DNR’s website at www.iowadnr.gov/InsideDNR/AboutDNR/EnforcementActions.aspx.

Consent Orders
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Black Hawk County
Abby J. Loeffelholz, dba Industrial Fabrication & Machining, Inc., Waterloo
Pay $1,450 penalty for failure to timely submit Minor Source Emission Inventory for 2012.

Clayton County
Douglas Reimer
Pay $6,000 penalty to resolve violations resulting from a manure discharge from a confinement feeding operation that resulted in water quality violations.

Clinton County
Joe Seng, Lost Nation
Pay $3,000 penalty for the purpose of resolving air quality violations which occurred during the renovation of a building in Lost Nation.

Crawford County
Denison Municipal Utilities and Farmland Foods, Inc.
Order requires Farmland Foods to pay $10,000 penalty for past wastewater violations.  Order also sets forth a schedule to achieve and maintain compliance with applicable requirements related to the operation of the Denison Municipal Utilities’ wastewater treatment plant and sanitary sewer collection system.  This includes pretreatment requirements for Farmland Foods.

Hardin County
The Maschhoffs, Inc., Buckeye
Comply with wastewater and air quality construction permitting requirements and pay $10,000 penalty.

Jefferson County
Millard Elston III and The Earthman, L.C., Fairfield
Pay $2,000 penalty to resolve air quality and solid waste violations that occurred during the demolition of trailers and the burning and disposal of associated solid waste from the trailer park.

Linn County
McLanahan Corporation, Cedar Rapids
Pay $1,000 penalty for failure to timely submit Minor Source Emission Inventory (MSEI) for 2012.  Order also requires submittal of MSEI and stipulated penalties if the MSEI is not submitted.

Muscatine County
Northern Filter Media, Inc., Muscatine
Pay $1,000 penalty for failure to timely submit Minor Source Emission Inventory (MSEI) for 2012.  Order also requires submittal of MSEI and stipulated penalties if the MSEI is not submitted.

O’Brien County
City View Farms, LLC
Institute improvements at facility and pay $10,000 penalty for past manure discharges.

Webster County
Quarry Services, Inc., Fort Dodge
Pay $5,000 penalty for failure to have a storm water permit for the discharge of pollutants from a gypsum mine into a water of the state.

Consent Amendments
A consent amendment is issued in settlement of a previous administrative order or to amend a pre‚Äźexisting consent order. A consent amendment indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Dallas County
City of Minburn
Amendment to extend the completion date for construction of wastewater collection facility.
