On July 3, 2013, EPA issued a memorandum providing guidance to permitting authorities on how to process RICE NESHAP compliance extension requests. (The RICE NESHAP is formally known as the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Reciprocating Internal Combustion Engines (RICE), 40 Code of Federal Regulations (CFR) Part 63, Subpart ZZZZ.) The memo includes guidance on handling requests submitted after May 3, 2013, the compliance date for many compression ignition engines. On June 28, 2013, EPA granted reconsideration of three issues raised in petitions for reconsideration of the January 30, 2013 final amendments to the 2010 RICE NESHAP. EPA’s letters to the petitioners can be accessed at http://www.epa.gov/ttn/atw/rice/20130628reconsideration.pdf.
Iowa has not adopted the RICE NESHAP amendments, and is currently not delegated authority to implement or enforce these standards.
