EPA published a Federal Register notice today to issue a stay of the Chemical Manufacturing Area Source rule (40 CFR 63 Subpart VVVVVV; National Emission Standards for Hazardous Air Pollutants (NESHAP) for Chemical Manufacturing Area Sources).
This federal rule was finalized on October 29, 2009, and had an upcoming compliance deadline of October 29, 2012, for existing sources. EPA’s new compliance deadline is December 24, 2012
On January 30, 2012, EPA published a proposed reconsideration of this rule in order to re-evaluate certain provisions, some of which would affect applicability. Since the final reconsideration is not yet completed, EPA has issued this stay on the compliance date. EPA states that a short stay of the final rule is appropriate to allow the EPA the time necessary to complete the reconsideration action.
At this time, Iowa has not adopted the Chemical Manufacturing Area Source NESHAP. Following EPA’s completion of its reconsideration rule, the DNR plans to seek input on adopting these regulations.
